In the start of the seventh Harry Potter book, how can Hermione use magic?

At the start of the seventh book, Hermione & Ron go on about Harry not using magic because of the “trace.” In the third book, Hermione mentions that her birthday is in the start of september. Presumably, it can only be July/August because Harry had just celebrated his birthday. How does she manage to perform magic without being detected?
